1. Who we are

This website is operated by Advocate Kanchan Talreja (Law Offices of Kanchan Talreja & Associates), a sole proprietorship of Adv. Kanchan Talreja (Bar Council of Maharashtra & Goa, MAH/3859/2016), 205, 2nd Floor, Dalamal Chambers, 29, New Marine Lines, Mumbai 400 020, Maharashtra, India (“we“, “us“). We are the Data Fiduciary for the personal data described here. The same practice operates www.eaglelawandintegrity.com, and this policy applies to both websites. We follow the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025, the Information Technology Act, 2000 and the rules made under it, and the confidentiality duties of advocates under the Advocates Act, 1961, the Bar Council of India Rules and the Bharatiya Sakshya Adhiniyam, 2023.

2. Before you contact us

An enquiry does not create an advocate–client relationship. That relationship begins only when we confirm our engagement in writing. So that we can first check for conflicts of interest, please send only a brief outline of your matter and the names of the parties involved. Do not send documents or confidential details until we confirm that we can act for you.

3. What we collect

  • Enquiries: name, phone, email, city and country, preferred language, the parties involved, and a short description of your matter.
  • Clients: as your matter requires, identity documents (PAN, passport, or masked Aadhaar); marriage, family and children’s details; financial information, including what is needed for the Affidavit of Disclosure of Assets and Liabilities in maintenance proceedings; health records only where directly relevant; details of foreign proceedings or orders; and your communications with us.
  • Other people: details of opposite parties, family members, children and witnesses, where needed for a legal matter.
  • Website use: IP address, device and browser type, pages visited, and cookie data (see section 8).

4. Why we use it

We use personal data to respond to enquiries and check for conflicts, to advise and represent clients before courts and authorities, to bill and keep accounts, to comply with law and court orders, to keep the website secure, and to protect our legal rights. We do so on the basis of your consent, data you have provided voluntarily for a purpose (section 7(a), DPDP Act), legal obligations, and the exemption for enforcing legal rights and claims (section 17(1)(a), DPDP Act). We never sell personal data or use it for marketing or advertising.

5. Consent

Where we rely on consent, we ask for it clearly, through the enquiry form or your engagement letter. Browsing the website is not consent. You may withdraw consent at any time by emailing solutions@advkanchantalreja.com. Withdrawal does not affect anything already done, and material already filed in court cannot be withdrawn. We may also keep records that the law requires us to keep.

6. Confidentiality and sharing

Advocate–client communications are privileged and confidential. We share personal data only as far as needed with: courts, tribunals and authorities (court filings may become public record); opposite parties’ advocates, where legal procedure requires; counsel, experts, translators and, on your instructions, advocates abroad; our service providers (hosting, email, cloud storage, IT support, banking), who are bound to confidentiality; and anyone to whom the law or a court order requires disclosure.

7. Transfers outside India

To act for clients living abroad, and because some of our service providers store data overseas, personal data may be transferred outside India. Any such transfer is made in accordance with section 16 of the DPDP Act.

8. Cookies

We use strictly necessary cookies to run the website. We use analytics cookies (Google Analytics 4, retained for up to 14 months) only if you click “Accept” on our cookie banner. Embedded services such as Google Maps and WhatsApp may set their own cookies, and their own privacy policies apply. You can change your choice at any time through “Cookie settings” in the website footer.

9. Security and breaches

We use reasonable security safeguards, including encryption, access limited to those working on a matter, two-factor authentication, access logs and confidentiality obligations on our team and service providers. If a breach affects your data, we will inform you without delay and report it to the Data Protection Board of India and any other authority, as the law requires.

10. How long we keep it

  • Enquiries that do not lead to an engagement: 12 months. We keep a minimal record of names and parties for conflict checks.
  • Client files and billing records: 8 years after the matter ends, or longer if the law or pending proceedings require it.
  • Website logs: at least one year. Analytics data: up to 14 months.

After this, we securely delete or anonymise the data.

11. Your rights

You may request a summary of your personal data and how it is processed; ask us to correct, complete, update or erase it; withdraw consent; raise a grievance; and nominate another person to exercise these rights in the event of your death or incapacity (sections 11 to 14, DPDP Act). Email solutions@advkanchantalreja.com with the subject line “Data Request”. We may verify your identity, and we will respond within 30 days. Some rights are limited where data is held to enforce or defend legal claims, or is privileged. For example, we cannot give an opposite party access to our client’s file. Please give us accurate information, and share another person’s data with us only where you are entitled to do so (section 15, DPDP Act).

12. Children

This website is not intended for persons under 18. Where a matter involves a child, we process the child’s information through the parent or lawful guardian, or as a court directs, with regard to the child’s welfare. We never use children’s data for tracking or advertising.

We will resolve grievances within 30 days. If you are not satisfied with our response, you may complain to the Data Protection Board of India.

14. Changes and governing law

We may update this policy, and the latest version will always appear on this page. This policy is governed by Indian law, and the courts at Mumbai have jurisdiction, subject to the jurisdiction of the Data Protection Board of India. A Hindi, Marathi or Gujarati version is available on request.
